Terms and conditions of use
1) Presentation
“Location-vacances-montagne.net” is a service proposed by SARL MATTELIX, a French-law limited liability company with a registered capital of 8,000 € entered into the Albertville register of companies – n° 491.543.823.

“Location-vacances-montagne.net” is a multimedia journal that abstains from any activity as described and regulated by the law of 2nd January, 1970.
“Location-vacances-montagne.net” interferes in no way in the search for property rentals and in subsequent transactions. Its sole purpose is to publish an online choice of advertisements for holiday rentals. “Location-vacances-montagne.net” (LVM) publishes such advertisements for the use of private individuals.
2) Booking and registration for owners and customers
2-1) Contract links
No contract is signed between LVM and the customer, who is directly connected with the property owner (the advertiser). Customer and advertiser will agree on a rental contract as described in the owner’s advertisement.
LVM does not act as intermediary in the contract and is no warrant to its good performance.
When using LVM’s services, both advertiser and customer express their agreement on the terms and conditions here described and accept that LVM has no responsibility whatsoever in the contract.
LVM reserves the right to modify these terms and conditions and invites users to consult them regularly.
2-2) The owner
The advertiser attests to his capacity as owner and allows LVM and its partners to publish his advertisement (texts and photos) in any medium, notably for promotion purposes. Copyright of the photos provided by the advertiser has to be certified as his own. Upon registration, the advertiser will also provide LVM a document certifying that he is the owner of the property to be rented. The owner will reach an agreement with the customer of his choice with no interference of LVM, except for all of the options linked to the management of his online schedule.
The owner is warrant to his personal details and property descriptions provided to LVM. Photos showing his property from inside and / or outside have to be certified as an accurate reflection of reality.
The advertisement will be considered duly drafted online unless otherwise specified by the owner to LVM within seven days following publication.
LVM bears no responsibility in the contents of the advertisements published on its web site, which are solely written and updated by owners. The owner is accountable for his advertisement, and he disclaims LVM’s responsibility towards third parties.
Advertisement fees applicable to owners are revised every year.
Secure online payment is available via Paypal ®:
a) booking is validated by the customer by clicking on the button for payment
of a deposit
b) the customer fills in the SSL secure forms hosted by Paypal ® if he is not
registered yet and transaction is dealt with by Paypal®
c) the customer returns to LVM’s website and payment is credited on the property
owner’s account
d) settlement marks acceptance of terms and conditions.
2-3) The customer
It is up to the customer to check the veracity of information provided in the advertisements. Upon the customer’s request, proof of ownership has to provided by the owner of property to be rented.
If, during his stay, the customer notes that important information was missing in the owner’s advertisement or that information provided in the advertisement does not correspond to reality, he can report his remarks to LVM by email at: contact@location-vacances-montagne.net
Connection to this service is totally free for the customer and no commission will be charged by LVM.
2-4) Booking update
Once registered on LVM’s website, it is up to the advertiser to update his rental schedule, failing which LVM reserves the right to withdraw the owner’s advertisement.
Schedule and prices update is made in January for following summer and in August for the winter season. Without due information from the advertiser, his property will not be included in LVM’s online offer.
Update of his rental schedule must be made directly by the advertiser on LVM’s website. LVM will not be held responsible for the contents of advertisements published in its website or the lack of information or missing update.
3) Responsibility restrictive clause
Contents of an advertisement are placed under the property owner’s sole responsibility. LVM subsequently disclaims all responsibility towards third parties.
In case LVM would be sued due to mistakes in an advertisement or to fault in the advertiser’s effective ownership of property to be rented, the advertiser commits himself in advance to preserving MATTELIX company and releasing it from any sentence that would be pronounced against it.
4) Optional services
4-1) Online rental contract
Both advertiser and customer can obtain a free and automatically generated printed copy of the rental contract, which will be issued by LVM. Both parties are free to modify the clauses inserted in the standard contract, but in this case, LVM will not be able to issue a printed copy of the contract.
4-2) Online payment
Both advertiser and customer are free to determine the method and conditions of payment. Online payment is possible on LVM’s platform.
Secure online payment can be made thanks to the 128 bits SSL encryption system used by LVM, with advanced tools to ensure the security of transactions. Consultation or modification of an account is made on systematically secure pages.
A commission of five (5) percent of the amount of the deposit made by the customer when booking online will be charged every six months to the property owner, in order to cover bank and securing costs.
5) Links to personal pages
In exchange for a return link to LVM’s site, LVM can add an hypertext link in the property owner’s advertisement, directing the customer to the owner’s personal page on the property for rent.
As no permanent control can be made over these personal pages, LVM cannot be held responsible for their contents by the property owner.
6) Technical maintenance and intellectual property
Location-Vacances-Montagne.net is available 7 days a week and 24h a day, subject to cases of absolute necessity and maintenance periods. Should a technical problem occur, preventing access to LVM’s services, LVM will take all possible steps to find solutions so that access is restored. However, LVM is bound by means and cannot be held responsible for the consequences of service interruption for reasons outside LVM’s control.
Contents published on LVM’s website are protected by copyright.
7) Protection of persons and property
In order to comply with legislation regarding protection of persons and property, LVM reserves the right to refuse any advertisement or photo that would appear incompatible with its activity or liable to generate complaints from third parties.
After examination, LVM reserves the right to remove an advertisement or a photo generating complaints from third parties.
The property owner can also remove his advertisement at any time.
In all cases, subscription to LVM’s services will not be refunded.
In accordance with the law “Loi Informatique et Libertés” you have the right to access, change, correct and delete information concerning you (Loi 78-07 of 6th January, 1978). Users’ email addresses constitute a database that LVM will not distribute, sell, transfer or share.
This database is declared to the CNIL under number 1196606.
8) Competent jurisdiction
All parties expressly acknowledge the competence of the county court of Albertville for all lawsuits involving SARL MATTELIX.
